ORDINANCE No. 176309

* Agreement with the Oregon Department of Transportation to provide services for the Willamette River Ross Island Bridge Replacement and Rehabilitation Project. (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

 1.  Powell Blvd (US 26) is part of the state highway system under the jurisdiction and control of the Oregon Transportation Commission. Willamette (Ross Island) Bridge No 5054 is located on US 26 and is also under the jurisdiction and control of the Oregon Transportation Commission.

 2.  The Oregon Department of Transportation (ODOT) replaced the bridge railing on each side of the roadway.

3.  ODOT agreed, through ODOT Letter of Intent number 17876 to have the City provide services during the construction of the Project.

 4.  The Project is complete and ODOT has updated the reimbursable costs of the        project.

5.  ODOT will reimburse the City for the costs of their construction services. The City will reimburse ODOT for the costs of their removal services.

 6.  ODOT has prepared an agreement for City approval and execution.

NOW, THEREFORE, the Council Directs:

 a.  The Mayor and the Auditor are hereby authorized to enter into an agreement similar in form to the agreement attached to the original of this ordinance, and by this reference made a part hereof.

Section 2.  The Council declares that an emergency exists because delay in executing this agreement would delay reimbursement of services already rendered; therefore, this ordinance shall be in force and effect from and after its passage by the Council.
