ORDINANCE No. 176303

*Extend Agreement with I-Corp. International, Inc. (Ordinance, amend Agreement No. 33960)

The City of Portland ordains:

Section 1.  The Council finds:

1.  The City required expert consultation services to assist in the matter of the Portland Classical Chinese Garden Pond Leak.

2.  I-Corp. International previously had been hired by Portland Classical Chinese Garden, Inc. to determine the cause of the pond leak and is familiar with the issues presented relating to the leak.

3.  I-Corp International agreed to provide consultation services to the City Attorney's Office about its previous findings regarding the Classical Chinese Garden Pond, to provide additional advice as required, and to testify if needed in any legal proceeding, by Agreement No. 33960, for a total authorized amount of $19,500.

4.  Because of the complexity of the matter, the need to do additional testing to determine the cause of the leak, and to recommend appropriate measures to repair the leak, it is necessary to increase the authorized amount of this agreement in the amount of $23,500.

NOW, THEREFORE, the Council directs:

a.  The City Attorney is authorized to extend Agreement No. 33960, dated October 11, 2001, to provide for expert consultation services in an additional amount of $23,500, for a total amount not to exceed $43,000.

b.  If applicable, the provisions of City Code Chapter 5.68 are waived.

c.  The Mayor and Auditor are authorized to draw and deliver checks in payment of expert services provided under this Agreement chargeable to the Classical Chinese Garden Trust Account.

Section 2.  The Council declares that an emergency exists in order to obtain the expert advice and recommendations necessary to determine appropriate measures for an efficient and timely repair of the pond leak; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
