ORDINANCE NO. 176287

 

*Amend Intergovernmental Agreement with Portland Development Commission for the design and construction of the Portland Police Mounted Patrol Unit at the Centennial Mills site (Ordinance; amend Contract No. 51496)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  On January 10, 2001, the Commission approved Resolution No. 5607 for an Intergovernmental Agreement (“IGA”) with BGS for the design and construction of the Mounted Police Unit (“MPU”) in an amount not to exceed $2,235,000.

 

2.  Pursuant to Resolution 5607, Commission directed staff and BGS to jointly manage the design and construction of the MPU.

 

3.  City Council Ordinance No. 175335 on February 14, 2001 authorized the IGA for the design and construction of the MPU between the Commission and BGS.

 

4.  On June 13, 2001, the Commission approved Resolution No. 5693 for an Amendment to the IGA for remediation of contaminated soil on the MPU site at a cost of $195,000 for a total authorized amount of $2,430,000.

 

5.  On September 12, 2001, the Commission approved Resolution No. 5760 for an Amendment to the IGA to complete the construction of the MPU at a cost of $459,000 for a total authorized amount of $2,889,000.

 

6.  City Council Ordinance No. 176182 on January 2, 2002 authorized Amendment No. 1 to complete the construction of the MPU.

 

7.  BGS is requesting a time extension to Intergovernmental Agreement No. 51496 for a new termination date of June 30, 2002 to allow time to complete the Work.

 

NOW THEREFORE, the Council directs:

 

a.  The Mayor and Auditor hereby are authorized to approve on behalf of the City of Portland, Amendment No. 2, for a time extension through June 30, 2002, to Intergovernmental Agreement No. 51496 between the Bureau of General Services and the Portland Development Commission for the design and construction of the Portland Police Mounted Patrol Unit facility.

 

b.  Unless specifically modified by this Amendment, all other terms and conditions of the original Agreement, as previously amended, shall remain the same.

Section 2.  

The Council declares that an emergency exists because a delay may result in additional expense, and will unnecessarily deprive the City of the benefits of completion of the contract at an early date; therefore this ordinance shall be in force and effect from and after its passage by the Council.
